COPYRIGHT POLICY

This copyright agreement is between you and QNAUS.COM (hereinafter referred to as We, Us, or Ours). This copyright agreement covers your protection as a contributor as well as our interests. This agreement does not change your rights to use your works in any other purpose.

By uploading your works (hereinafter referred to as "Your Content"), you accept and agree to the following terms. Except for the license granted to us and recipients of our Service, you reserve all rights, title and interest to Your Content. Subject to the terms and conditions of the agreement, you hereby grant Us and to recipients of software distributed by Us a perpetual, non-exclusive, royalty-free, irrevocable copyright license to reproduce, prepare derivative works, display, perform, sublicense and distribute Your Content and such derivative works.

You represent that you are legally entitled to grant the above license. If your employer, superior, or other overseer has rights to intellectual property that you create that includes Your Content, then you represent that you have received permission to make contributions on behalf of such employer, superior or other overseer. You also acknowledge that your employer, superior or other overseer has waived such rights for your contribution to Us or that your employer, superior or other overseer has executed a separate contributor agreement with Us.

You represent that Your Content is Your contribution or original content. Where applicable, third party licensing should be documented including (but not restricted to) patents, trademarks and trade dress.

You are aware that We are not obligated to utilize Your Content as part of the Service and that you will not assert such rights.

You are not expected to provide support for Your Content except to the extent you are willing to do so. Unless otherwise required by law, your contribution is on an as-is basis without warranties or conditions of any kind, including fitness for a particular purpose.

If you submit work to Us that is not your original creation, you may submit it by identifying the complete details of its source and any copyright restrictions along with proper fair use rationale. Copyright applies to products such as audio and visual works, music, written works, artwork, advertising, software, and dramatic works. Ideas, facts and processes are not subject to copyright. Names and titles are not of themselves subject to copyright.

We are not able to mediate ownership or copyright disputes. However, we reserve the right to remove any subset of Your Content that is in violation of copyright law. If we receive a copyright infringement notice, any impacted content can be removed as the law requires. If a counter notification is received, we will forward it to the party that requested the removal. From there, the two parties must resolve the issue on their own strength.

Trademark law protects brand names, logos, trade dress, and other identifiers. Patent law protects inventions. Violations of trademark and patents will be followed equally using this framework.

If your friend or someone else uploaded any video, image or other work involving You without Your Permission and you feel it violates your privacy or safety, this is dealt with using a privacy complaint.

Fair Use: Fair use of copyright material is subject to the following:

  • Commercial use of a copyrighted work or logo is less likely to be considered fair use compared to an educational use.
  • Using material from primarily factual works is more likely fair use compared to fictional works.
  • Using a subset of an original work is more likely to be fair use than using a large portion of the works.
  • Uses that harm the copyright owner's ability to profit from the original work are less likely to be ruled as fair use.
  • Even if you credit the original copyright or trademark holder when you use such material or post a disclaimer it is not of itself considered a fair use.

Public Domain Materials: You are responsible to verify if a work is in the public domain before uploading it to the Service.

Creative Commons Licensing: For more information on Creative Commons Licensing, please visit https://creativecommons.org. Content carrying Creative Commons Licensing may be uploaded to the Service subject to the terms and conditions of the type of license:

  • BY: Credit is required for the original author.
  • SA: Items posted must have also be licensed under the SA license.
  • NC: Permission is required of the author for commercial use.
  • ND: No derivatives of the work permitted - permission is required to modify the original work.

Note that all CC Licenses require attribution of the original author.

Enforcement of copyright?

Copyright may be enforced by the following:

  • Removal of the copyrighted material
  • You may not gain any financial or virtual assets from use of the work where applicable.
